Denied & Underpaid Claims
After a major hurricane, insurers process thousands of claims fast — and many first offers leave out entire rooms, roof slopes, code upgrades, or contents. A denial or low payment is not the end of your claim. We review the carrier's estimate and denial letter against your policy, document what was missed, and pursue a reopened or supplemental claim within Florida's deadlines.
Signs of damage
- The check won't cover a contractor's repair estimate
- The insurer approved repairs to part of the roof but not the rest
- Interior damage was blamed on 'wear and tear' or 'pre-existing' conditions
- The payment fell just under your hurricane deductible
- A denial letter cites an exclusion you don't understand
How insurers underpay
- Desk adjusting from photos instead of a full inspection
- Low unit pricing that doesn't match local post-storm labor costs
- Omitting overhead and profit, code upgrades, and matching
- Pressuring owners to accept a 'final' payment quickly
What to do now
- Don't sign a release or cash a check marked 'final' until it's reviewed
- Request a copy of the insurer's estimate, photos, and any engineer report
- Keep your contractor's estimate and any repair invoices
- Send us the denial or payment letter — we'll review it for free
Frequently asked questions
Can I reopen a denied or underpaid hurricane claim in Florida?
Yes, within the deadlines. Under Fla. Stat. 627.70132, a reopened claim must be noticed within 1 year of the date of loss (the landfall date for a hurricane), and a supplemental claim for additional damage within 18 months.
Why was my hurricane claim underpaid?
Common reasons include missed damage, low unit prices, leaving out code upgrades or matching, attributing damage to wear and tear, and estimates that fall just under the hurricane deductible. A line-by-line review usually shows where the gap is.
Does it cost anything to have my denial reviewed?
No. We review denial letters and insurer estimates for free. If we take the claim, our fee is a percentage of what we recover — no recovery, no fee.
